| On the example of the semantic transformation of the concept of "legal consciousness" in the Russian legal dis
course of the 19th-20th centuries, the article examines the problem of the correlation between the language of legal
science and legal thinking. The appearance of this term is interpreted as one of the signs of the restructuring of the ob
ject field of jurisprudence in the last third of the 19th century, namely, the emphasizing of the individual psyche as a
key factor determining the processes in the legal sphere. Further changes in the meaning of the term "legal conscious
ness" are associated with the influence of the Marxist theory of society and the establishment of the dominance of a
"narrow normative approach" in the Soviet theory of law. It is noted that the changes in the language of legal discourse
directly reflect the structural transformation of legal thinking. Author reveals the ideological implications contained in
various meanings of the concept of "legal consciousness", which determine specific ways of understanding an individ
ual's attitude to legal reality. |
