Abstract
The aim of the work is to determine the necessity and sufficiency of modernizing the norms of criminal law that can withstand new criminal challenges in the rapidly developing and high-tech field of bioeconomics. The research methodology includes logical, formal-legal and systematic methods that make it possible to anticipate which new forms of criminal activity may arise in the field of bioeconomics and which norms of the Russian Criminal Code are capable of countering them. The result of the study is the actualization of the problem of criminal law regulation in the field of bioeconomics, which is determined by the absence in Russia of special norms providing for criminal liability for crimes in this area. Biotechnologies represent a new field of human knowledge, in which criminal risks have not yet been adequately understood at the doctrinal and expert level. At the same time, the process of penetration of these technologies into social reality is capable of shaking complex aspects of life (DNA recombination, genome editing, artificial creation of living organs and tissues, etc.), it is rapid and can generate previously unknown criminal threats. The author concludes that the list of principles of criminal law regulation (legality, equality of citizens before the law, guilt, justice, humanism) should be supplemented by the principle of economy of criminal repression, and the modernization of criminal legislation for the purpose of protecting the interests of bioeconomics should serve not to limit the scientific and technological capabilities of modern society, but to be combined with civil, administrative, environmental legislation and international law, a tool for their protection, a means of preventing abuse, ensuring security and sustainable development.
