Abstract
This article discusses a number of controversial issues related to the interpretation of a confrontation in criminal proceedings. It defines the legal nature and procedural aspects of the confrontation, as well as its purpose and main objectives. Special attention is given to the legal norms governing the confrontation, as well as the practical aspects of this investigative action. The article argues that the confrontation is an independent investigative action, along with interrogation. The purpose of this article is to identify the challenges in interpreting the confrontation in criminal proceedings and propose ways to improve the legal framework governing this investigative action. To achieve the research goal, general scientific (dialectics, analysis, synthesis, induction, deduction, and abstraction) and special legal (formal legal, comparative legal, technical legal analysis, and interpretation) methods of scientific cognition were used. The author proposes legal regulation of the time, place, and number of persons between whom a confrontation can be held simultaneously. The author defines a confrontation as an independent investigative action used to clarify the circumstances related to the objective and subjective elements of a crime by comparing the testimonies of suspects, accused persons, victims, witnesses, and other participants in the process in order to eliminate significant contradictions. We believe that this definition can be included in the note to Article 192 of the Criminal Procedure Code of the Russian Federation, as it covers the main features and requirements of a confrontation, which will help law enforcement officers avoid illegal actions and shortcomings during its implementation.
