| The purpose of the study is to determine the trends and prospects of applying economic analysis of law in the rule-making of the Russian Federation on the example of the RIA procedure. The methods used in the study are as follows: analysis, synthesis, induction, the system method, the structural-functional method, and the comparative method. The study was based on foreign and Russian-language sources on economic analysis of law. The conclusions made during the study are as follows. The implementation of RIA contributes to the refinement of positivist approaches to law and the development of externalist approaches to legal understanding. Economic analysis of law is important for Russia and continental Europe in rule-making, and therefore the application of RIA is important. Also, RIA is considered in the light of the new institutional economic theory (NIET) and the implementation of the approaches of this scientific school in the rule-making process. |
