Contractual legislation establishes the sequence of actions for participants in state and municipal procurement. The main stage of the procurement procedure is its actual implementation, and violations at this stage negatively impact the effectiveness of meeting state and municipal needs. The purpose of this study is to identify shortcomings in administrative offense legislation in the relevant area. The research methods used include both general scientific methods of cognition-analysis, synthesis, and abstractionand a specific scientific, formal-legal method. The article provides practical proposals for amending legislation to address gaps in the regulatory framework governing liability for violating the procedure for state and municipal procurement. A theoretical definition of violation of the procedure for the procurement of goods, works, and services to meet state and municipal needs is formulated. A conclusion is drawn regarding the need to close the gap in Part 9 of Article 7.30.1 of the Code of Administrative Offenses of the Russian Federation regarding the establishment of liability for officials of the operator of an electronic platform or a specialized electronic platform for failure to send or untimely sending to the customer a withdrawal of a supplier's application. It is proposed to establish a separate offence related to the unjustified limitation of the number of procurement participants as a result of failure to comply with the requirements for the procedure or deadline for posting information and documents.
